MACC – WHAT IS TO BECOME OF IT?

If anyone were to ask me whether I have faith and confidence in MACC being a truly independent, trustworthy and professional investigative organ of the government, my answer is simply NO. I had all along been weary and doubtful of the competency of MACC, and the results of the Royal Commission of Inquiry (RCI) into the death of Teoh Beng Hock confirms it all. I now believe that the organization needs a complete revamp from ‘head to toe’, and any future recruitment of its officers must satisfy one important criterion i.e. the person regardless of race or religion must be God fearing. If this criterion is not met, then there is no way that I can trust MACC to improve itself. I know this is a tough criterion to meet, more so if the officers know that they have unquestionable and exceedingly powerful authority to investigate, and that anything they do (rightfully or wrongfully) will be protected by the very organization they serve. With so much of power in their hands, any normal person tends to lose their sense of responsibility and level headedness, and they turn from being a normal human being to a hated devil. These were the obvious qualities found in the three MACC officers implicated in the death of Teoh i.e. Hishamuddin Hashim, Arman Alias and Mohd Ashraf Yunus; all of them are Malays and I suppose they profess the Islamic faith. I simply do not know if they had ever realized that their actions against Teoh that caused him to take his life (according to the RCI report) are un-Islamic. They now ought to know the consequences of their acts in the afterlife…………something that no mortal will ever escape.

Seriously, the RCI report has brought to light the serious flaws in MACC that is unknown to the public. Yet they (MACC) remain elusive when the public questioned their conduct and method used during an investigation, as if they are not answerable to anybody for their actions; not even to God. We have also seen how some of our leaders jumped quickly to the rescue of the MACC if there is a public criticism against them (MACC), regardless of the nature and reason for the criticism. This is what our leaders have finally created the MACC to be; a ruthless, vindictive, inhumane, irresponsible, senseless, barbaric investigative organ of the government that is suppose to investigate corruption cases truthfully, impartially and in all fairness to the alleged offenders. They are expected to find out the truth and nothing but the truth, so that the alleged offenders gets proper justice.

With the conclusion of the RCI, the public is now more intimate and exposed to the inner workings of the MACC. The MACC can no longer act like the devil, and every step they take will now be under strict public scrutiny. Besides answering to God for their actions in the hereafter, they will have to first answer to the public for the actions on earth. The people would now expect their parliamentarians (regardless of the party they represent) upon whom they have placed their faith and trust, to be monitoring closely the activities of the MACC henceforth. And if our parliamentarians are to play their roles well by maintaining a close watch on the activities of MACC, I believe the country will have a truly professional MACC that does not need another RCI.

The problems made so clear by the RCI will never be resolved unless there are REAL checks and balances in the entire system. The constitution has been amended in the past, so many times, that many built-in checks and balances are no longer there, or have been seriously compromised.

The country needs a strong executive, a strong parliament, a strong judiciary, an independent press, freedom of speech, and a strong opposition (even if it has to be BN at times).

Along with the constitution then the checks and balances can have a chance to work (and an organisation like MACC can then do its job).

Also the pervasive patronage cult needs to somehow be brought under control as this is one of the key elements that started the rot.

My fear is that things have gone so far in the wrong direction, that it will require a major event to turn the tide back. I hope I am wrong, for the sake of our children. I don't see much though to be optimistic about, except the recent bersih rally. People came out even in the face of all the fear mongering and verbal abuse, without anarchy resulting. It's a very small step though.

The next step that is needed is to make the election process honest and transparent, and the press free.

My advice to those in power. Loosen the iron grip. Trust your own people. Stop treating everyone like children. Stop encouraging the cult personality syndrome. Stop pandering to money and riches.

That last paragraph -- is EXACTLY the problem. Regrettably it was in Dr. M's tenure that this occurred. He did so much to build up the country during his time (in a physical/material way). But in doing so he nearly destroyed the constitutional foundation of the country (due to his impatience). Patronage also then became so thoroughly entrenched that it's tentacles are in every corner now.

I think the report is just trying to divert our attention from finding the truth on Teoh Beng Hock's death. I don't believe it's the weak personality of TBH and pressure from MACC that resulted him to commit suicide.

We all know that MACC is under the influence of the political master, UMNO. Actually, our civil servants are all under the influence of their political master. We can easily observe on how the police threated Bersih protestor, judges on Anwar and Perak case, etc. The problem is not MACC employee but the employer. The core of the problem is UMNO. I definitely applaud MACC investigating corruption cases but I am curious why there is not similar attention on the submarine purchase, illegal logging, Sungai Besi army base, etc.

We have good system but it's UMNO that abuse the system. UMNO is worse then the British.

I was reading a statement made by our PM stating that there is communist influence on Bersih. Hence, there is 6 politician arrested under ISA.

I know you fought the communist and many of your readers. So, would any of you old soldier care to share your thoughts about communism influence in Malaysia politic?

I know even the Chinese is ditching communism. I find it amused to read that stupid statement from our dumb PM.

I believe to use the communist threat and its revival in the Malaysian scene is a ploy. I do not believe it, even if you force me to. It is a fear that is being created to justify their ultramotives. Plain and simple.

Our PM says why have RCI if we do not accept their verdict. I am in total agreement with this. My question is why he did not say the same thing for the Lingam case. In the Lingam case the commissioners have found sufficient evidence of misbehaviour - ACA investigated and said- no abuse of power, and the AG said no further action needed. How is it possible that the Commissioners found sufficient evidence and yet there was no case?
Now, the commissioners for the Teoh Beng Hock case say suicide - so PM says we must accept the findings.
In conclusion; No point having Royal Commissions - a waste of time and money unless the commissioners are given the power to prosecute.
After all, the commissioners arrived at a conclusion based on the definitive evidence that they have. If they don't have the evidence they should not give a verdict.
Why does MACC need to investigate if they already have the evidence.
So one can surmise what will happen with TBH's case - MACC officers will investigate and say insufficient evidence of abuse of power and the AG will say case closed. You can call the RCI what you want but it still comes down to one person who decides on the action to be taken - The Attorney General.

Sekiranya semua pehak terlibat iaitu AG ,Polis,MACC telah melaksanakan tugas mereka secara professioanal mengikut lunas undang undang,without fear or favour, maka kes TBH tidak akan jadi begini kesudahannya.Mungkin juga dengan kes lain yang serupa denganya.Saya berpendapat pegawai pegawai MACC yang terlibat sepatutnya telah dipertuduhkan diMahkamah kerana membunuh awal awal lagi.Biarkan Mahkamah menentukan nasib mereka ini semua.Yang jadi masaalahnya ialah agensi yang saya nyatakan diatas tidak berfungsi sepatutnya dan cuba melindungi sesuatu dari raayat,membersihkan diri,bersekongkol didalam perbuatan jenayah,patuh kepada arahan tangan busuk dan lain lainnya.Kes TBH dan Sarbini telah menghakis kepercayaan raayat kepada sistem perundangan dinegara ini dan Insayallah raayat akan tukarkan dan tombangkan penguasa ini diPRU 13 nanti.
